Terms and Conditions
§ 1 Scope
These General Terms and Conditions (GTC) apply to all contracts between Landmaschinenhandel Werner, owned by Timo Werner, Weidig 5, 08258 Markneukirchen (hereinafter referred to as the “Seller”), and its customers concerning the purchase of machinery, vehicles, attachments and accessories.
§ 2 Conclusion of the Contract
The presentation of the machines on this website does not constitute a legally binding offer, but rather a non-binding invitation to make an enquiry. A contract of sale is only concluded upon express confirmation of the order by the seller or upon delivery of the goods. The terms and conditions agreed in each case shall apply.
§ 3 Prices
All prices include VAT at the statutory rate (19 per cent; itemised on request), plus carriage and delivery. We reserve the right to change prices and to sell goods to other parties. The price agreed at the time of order confirmation shall be binding.
§ 4 Delivery & Transport
The goods will be handed over fully assembled and ready for use. Delivery from our warehouse in 08258 Markneukirchen. Transport can be arranged on request; please provide your postcode so that we can calculate the delivery costs.
§ 5 Payment
Unless otherwise agreed, the purchase price is due for payment on handover or prior to dispatch of the goods. Individual financing and payment arrangements may be made by mutual agreement.
§ 6 Retention of title
The goods remain the property of the seller until full payment has been made.
§ 7 Warranty
For consumers, the warranty period is 2 years; for businesses, it is 1 year from the date of handover of the goods. In all other respects, the statutory provisions apply.
§ 8 Liability
The seller shall be liable without limitation for damage resulting from death, personal injury or damage to health, as well as in cases of wilful misconduct and gross negligence. In all other respects, liability is limited to foreseeable damage typical of the contract. Any further liability is excluded.
§ 9 Right of withdrawal
Consumers are entitled to a statutory right of withdrawal under the provisions of the German Civil Code (BGB) in respect of contracts concluded by distance selling or off-premises. Details, the consequences of withdrawal and the model withdrawal form can be found in our Cancellation Policy; we will also make these available to you before the contract is concluded. Business customers do not have a right of withdrawal.
§ 10 Dispute Resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final Provisions
The law of the Federal Republic of Germany shall apply. Should any individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
